These are the Terms and Conditions that will apply if you are booking one of our retreats or booking an appointment with me. Please read them carefully as you will be bound by them.
These Terms shall constitute the entire agreement between Anna Hughes Cambry, Spain, and the Client relating to the subject matter herein, and shall constitute a binding agreement. There is no verbal or written; representation, warranty, prior agreement, or description of services, other than as expressed herein.
The contract and booking is made with, and services will be provided by Anna Hughes Cambry. By booking a retreat or consultation , you agree to be bound by these Terms and Conditions that govern the relationship, the cancellation policy and limitations of liability. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.
Booking trips, consultation & the contract
All persons wishing to make a booking have carefully read and understand the Terms and Conditions that follow. By making a booking with Anna Hughes Cambry, you accept on behalf of yourself and all those named on the booking, to be bound by these Terms and Conditions. A booking is accepted and becomes definite only from the date when Anna Hughes Cambry sends a confirmation email, and when you have completed the deposit payment if payment is requested.
For all advertised retreats, a non-refundable deposit of 20% of the total value of the retreat per person plus submission of our online booking form is required to complete your booking.
The remaining balance will be paid either in total or in two installments, 50 % (minus the deposit) 90 days prior the event and a second payment of the same amount 30 days before the retreats starts.
If the final balance is not received by the due date, then your booking cannot be guaranteed and Balearic Retreats reserves the right to cancel your booking and forfeit your deposit.
*Please note deposits made on all bookings are non-refundable and non-creditable due to the requirement to purchase non-refundable and non-transferable essentials including but not limited to; accommodation reservations etc on your behalf to secure your spot on the retreat.
Refund / cancellation
We understand that unexpected events can arise that can affect your plans.
If you notify us 90 days or more before the retreat start date, the deposit can be transferred to another retreat taking place within one calendar year
If you cancel more than 45 days before the retreat start date, you may request a partial refund (less a cancellation fee equal to the deposit).
All retreat payments become non-refundable less than 45 days before the retreat start date.
You may also transfer the balance to a friend if you can´t make it.
All retreat prices shown are per person and are quoted and payable in EUR.
Balearic Retreats is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency.
Balearic Retreats reserves the right to alter the prices of any of the retreats arrangements shown on our website.
Unless stated otherwise, the price of your travel arrangement includes each and all of the component parts described within your booking confirmation invoice.
Not included in the price of your travel arrangement are flights, transport, travel insurance, excess baggage charges, tipping and any food or drink or additional excursions or activities which are not confirmed as being part of your retreat arrangements. Additionally, any items or services purchased during a retreat are not included in the cost of your travel arrangement unless specifically stated.
Medical conditions & special requirements
The Client must inform Anna Hughes Cambry on our registration form of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel or practice yoga and other activities. Failure to notify us may result in the Client being refused to participate in the retreat or certain activities during the retreat at the Client’s own expense.
Anna Hughes Cambry will do its best to meet Client’s special requests including dietary, but such requests do not form part of the Contract and therefore Anna Hughes Cambry is not liable for not providing these requests.
Cancellation of a retreat by the client
Any cancellation by a Client must be made in writing (via email) and be acknowledged by Anna Hughes Cambry in writing (via email).
Under no circumstances is your deposit refundable. Deposits are required to secure bookings.
If you cancel and you have made additional payments to your deposit, your full balance can be rolled over to another date of your same trip within one calendar year. If your trip is not offered again, you can switch locations and fees can be transferred.
Cancellation of a retreat by Anna Hughes Cambry
Anna Hughes Cambry reserves the right to cancel any retreat for any reason, but will not cancel a retreat less than 30 days before the retreat start date except for unusual or unforeseen circumstances outside Anna Hughes Cambry’s control. When a retreat is cancelled by Anna Hughes Cambry before the agreed date of departure for any reason other than the fault of the Client, the Client can either:
Transfer their deposit to another retreat taking place within two calendar years, or receive a full refund of all monies paid under the contract as soon as possible.
Anna Hughes Cambry is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. If the Client is offered a refund but requests an alternate retreat of a higher value than that originally booked, then the Client must pay the difference in price.
Anna Hughes Cambry shall not be responsible for not fulfilling its contractual obligations to the extent that the failure to fulfill is due to events outside its control, that is, force majeure events such as a pandemic, acts of God, fire, flood, cancellation of flights or/and prohibition of sailing due to adverse weather conditions, war, acts of terrorism, riot, civil commotion, governmental actions (excluding regulatory change), labour disputes, and any similar events. In such force majeure events, no refund shall be granted and all payments will be credited in the form of a voucher valid for two year from the start date of the canceled retreat.
Travel & health insurance
Anna Hughes Cambry recommends Clients to obtain travel medical insurance. This insurance must cover personal injury and emergency medical expenses including, but not limited to, helicopter evacuation, air ambulance and repatriation.
It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client during travel. Anna Hughes Cambry shall have no liability for loss, theft of or damage to baggage or personal effects..
The Client acknowledges that the cost of Anna Hughes Cambry’s retreats do not include insurance and that the Client has been advised to obtain separate coverage at an additional cost. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken.
The Client must be in possession of a valid passport required for entry, departure and travel to retreat destinations (passport must be valid 6 months past the return date), all visas, permits and certificates including vaccination certificates (if required), insurance policies, etc. are required for the whole of the journey. The Client accepts full responsibility for obtaining all such documents, visas and permits prior to the start of the retreat and is solely responsible for any adverse consequences resulting from missing or defective documentation.
Photos, video and content creation
In the course of participation in a Anna Hughes Cambry retreat, photos or videos may be taken by participants, teachers, hosts and professional photographers. These images may be used in any Anna Hughes Cambry’s promotional materials, website, all social media platforms (i.e. Instagram), etc., unless Clients specifically request to the photographer or in writing to Anna Hughes Cambry, to not use any material their image is depicted in. Otherwise, permission is granted to Anna Hughes Cambry to perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
Anna Hughes Cambry reserves the right to alter retreat programs, accommodation, teacher and and itineraries due to weather, illness, trip conditions or other circumstances. No refunds will be made in these cases.
To ensure that retreats and consultations run smoothly, Anna Hughes Cambry needs to use personal information (such as name, address, special needs, health conditions, dietary requirements retreats etc. depending on the typ of booking) provided by Clients to Anna Hughes Cambry, and also pass on such information to other suppliers involved in the operation of the retreat. Anna Hughes Cambry will apply appropriate security measures to protect such personal data and will only pass on data that is applicable to suppliers responsible for the retreat. By completing the Anna Hughes Cambry Booking Form, Clients consent to this information being transferred as required.
The Client acknowledges that during a retreat he participates voluntarily in any and all activities arranged by the retreat hosts, and insofar as legally permissible, surrender his right to any cause of action against Anna Hughes Cambry arising from any loss or damage to person or property that occurs during a retreat.
The Client hereby agrees to be responsible for his own welfare and accepts any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.
The Client hereby certify that is physically fit and has not been advised to not participate, by any means or in any manner, in any such activity arranged by the retreat hosts by a qualified medical professional. The Client hereby certifies that there are no health-related reasons or problems which preclude his participation in any and all activities arranged by Anna Hughes Cambry.
The Client hereby waives, releases and discharges from and against any and all liability from his participation on the trip and in any and all activities arranged by the retreat hosts, including but not limited to, liability arising from the negligence or fault of Anna Hughes Cambry and/or its employees and/or its collaborators and/or its subcontractors, for his death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to the Client including the Client´s trip to and from activities arranged by the retreat hosts,
COVID 19 SPECIAL CONDITIONS
Cancellations due to covid-19
If the retreat has to be cancelled due to a new lock-down in Spain, the guests will be able to either move their reservation to another retreat happening within the next two years or ask for a full refund.
In the case that the guest has to cancel the retreat due to new travel restrictions imposed in the country or origin, and is banned for traveling or forced to do a quarantine on arrival, the guest will have the option to change the reservation for another retreat happening within the next two years or get a full refund (minus the deposit)
In the case that the guest test positive in covid-19 just before traveling to Spain or destination of the retreat, the guest will be reimbursed with the last payment done (50% minus the deposit)
We highly recommend our guests to purchase a travel insurance to be covered in unexpected situations.
To guarantee the health, security and confidence of our guests, depending on the covid-19 situation at the moment of the retreat, Anna Hughes Cambry may ask the guests to do a PCR/Antigen test on arrival.
The Contract and these Terms and Conditions are subject to the laws of Spain.
Waiver of booking conditions
These Booking Terms and Conditions may only be waived or amended by written mutual consent. When a Client completes, submits and makes the payment for booking their place for a retreat, they agree to accept all these conditions, and when the booking is accepted, Anna Hughes Cambry agrees to carry out the obligations as defined therein.
Updating of terms & conditions
Anna Hughes Cambry reserves the right to update and/or alter these terms and conditions at any time, and it is the Client’s responsibility to be familiar with them. The latest terms and conditions may be found on annahughescambry.com
